Academy Golf Outing to Raise Money for Issues Defense Fund

In the classic movie "The Wizard of Oz," Dorothy, the Tinman, and the Scarecrow feared "lions and tigers and bears."  As a reflection of today's litigious society, the Amargosa vole, Pacific pocket mouse, and Carolina heelsplitter are among the creatures that make the pest management industry's proverbial heart stop beating.  These are among the almost 800 endangered species that will be part of a national lawsuit the activist group Center for Biological Diversity (CBD) intends to file under the Endangered Species Act (ESA) seeking to severely restrict the use of 400 pesticides throughout the entire United States. 
 
The impending litigation is just the latest but most comprehensive suit filed by CBD and other activist groups using the ESA to curtail the use of pesticides approved by the U.S. Environmental Protection Agency (EPA). The most frightening part of these lawsuits from an industry perspective is that they are guaranteed victories for CBD and their fellow activists groups as there is little dispute that EPA has not fulfilled its obligation under ESA to consult with the U.S. Fish and Wildlife Service and National Marine Fisheries Service when registering or reevaluating pesticides and the prospective risk they pose to endangered species and their habitat. Consequently, EPA has been negotiating settlements with the activist groups to avoid unfavorable court rulings.  Nevertheless, these agreements impact pesticide use patterns, and are reached by parties who don't necessarily have the professional pest management industry's best interests in mind.  
 
The upcoming "megasuit" - as it has been termed - is a major challenge for the professional pest management industry, and it requires the industry's fullest attention.  We absolutely must be involved in this suit as much as possible or the consequences could be significant.  Accordingly, NPMA has retained counsel to track this litigation and file a brief outlining the importance of retaining the use patterns of the pesticides the structural pest management industry uses, and the societal ramifications of losing those products.   These unanticipated costs could be significant, so NPMA established an Issues Defense Fund to prepare for the "Megasuit" and other future lawsuits.
 
The first fundraising event for the Issues Defense Fund will be held at Academy!
