In the latest chapter in the ongoing legal battle regarding the future of fipronil, BASF asked the U.S. District Court for the Middle District of North Carolina to find Makhteshim Agan of North America (MANA) in contempt for allegedly violating a court order restricting Makhteshim from manufacturing fipronil-based termiticides using any process other than that set forth in the order.
At the core of this latest legal action taken by BASF is whether or not Makhteshim infringed on a BASF “process (manufacturing) patent” for fipronil, and thus is in violation of an October 2010 consent agreement signed between the two parties.

Makhteshim and its U.S. subsidiary Control Solutions, Inc. (CSI) maintains that the motion has no merit, and announced that they will continue manufacturing, marketing and sales of their fipronil-based Taurus SC product despite BASF’s recent court filing.
